    Buying house from someone who filed chapter 7

    Ok.. Just wanted to get some opinions..

    A friend of mine was in a contract to buy a house from someone. After entering the contract to buy the house that someone told her they wouldnt sell because theres a lien they didnt know about on the house and the procedes from the sale would go to that instead of being profit and ensured her that it was a mistake.

    Now that someone has filed Chapter 7 and says they will sell the house to her.

    Now my rough understanding is that they cant sell the house since its an asset right now, correct? But this someone says thier attorney has entered some kind of motion to sell it.

    Wouldnt the trustee have to make this decision at or after the 341 meeting?

    My friend is under the impression that she will be able to still buy the house within the next month or so.

    I checked the file info on pacer and it shows a "No Asset Case" but these people own at least 2 houses, its not showing a 341 date.

    Anybody offer any suggestions or comments?

    Your friend who wants to buy the house needs to consult with an attorney. However, if title cannot be conveyed, the sale will not take place and any earnest money paid will be reimbursed to the buyer. This is one of those times when obtaining the services of a real estate agent is a good idea and a lawyer an even better idea.
