    default judgement by hoa to foreclose

    Hello< I live in Texas and had built my home in 2004 that is worth approximately $370,000 and owe $250,000 on it. I have been unable to work since september 2007 due to a back injury and 6 surgeries. I fell behind my hoa dues approximately $1200 but explained my situation to them and have submitted $25 monthly payments each month, which have all been accepted. I got a packet from an attorney who got a default judgement for $5200 with attorneys fees and penalties dated july 24th today that says if i appeal and lose, i will owe another $10,000. If anyone could help me understand what options i have to stop them from taking my home such as chapter 13 bk, designating the home to my father or aunt thru a warranty deed, actually selling it for exactly what i owe and tell them to sue me for it, or what time frame i am looking at before they can actually sell my home, i would greatly appreciate it. I was in the hospital when they sent the notice for a court date and didnt know about it. It just doesnt seem right that they could do this over such a small amount and after taking partial payments every month for 2 years. I would think that would imply a payment agreement was accepted by the hoa.
