    Question Re Car

    I have a truck that is in my name but my brother has made all the payments for it. This was in repayment for money he owed me from several years ago (about 15K). My name is on the registration and we are both on the insurance for driving it, and I pay the insurance each month. There is about 6 months left on the loan and I want to reaffirm the loan in my Chapter 7.

    The three attorneys I spoke with gave me somewhat differing opinions and advice so I'm unsure how to proceed. One said it's in your name, it doesn't matter who paid for it so just list it as your expense. Another said I should not list it as an expense unless I list the payments by my brother as income. The third said to just find out what the court thinks.

    I can only tell you what happened to me and not giving advice and this might not even help you. My niece has a car loan for her malibu that she is paying on and the loan is just in her name. When she moved to NY from Ohio, she couldn't get it registered because she did not have a NY license yet so I registered it in my name and just my name is on the insurance for it. My attorney said the loan is not in my name and I didn't have to list it on my BK. So I didn't. I am in NY might be different where you are.
