    Chapter 13 Problems reduced income

    I am 3 years completed of a 5 year 50 perc. payback of approx 80,000 in unsecured debt. I lost my part-time job and now I am falling behind on my mortgage payments, bills etc. Trustee paymts. are current, garnishment. I have been looking to replace the 20,000 yr part-time job with no sucess. I feel like I am back in the beginning telling secured creditors I will be late with paymts. etc. If I keep making the trustee paymts and I keep paying other bills late I am nervous the mortgage companies and auto will start to get a relief from the stay and I really want to keep my house and car. If I dismiss does anyone have any experience on how soon the unsecured creditors will start their attack, would they negotiate settlements, etc. I know it is only 2 years but I cannot live with this current budget. Should I try to roll the dice and ask for a reduction in my trustee payment or convert to a chapter 7. Any help would be appreciated.

    Call your attorney NOW and ask for a plan modification, possibly even a suspension of payments to give you time to catch up on your bills. We modified our plan from $1100/month and 65% payback to $400/month and 40% payback after almost 2 years in. Don't wait to get further behind! It takes 30+ days for paperwork to get ruled on, so the faster you submit, the better off you'll be.

    Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!
