    341 Meeting Questions

    Okay, I've read and I'm pretty sure what they are going to ask at the 341 meeting. Like how did you get so far in debt.

    My question is did you tell the whole story or just a brief description? When I'm nervous I tend to babble on and don't want to bore and go into to much detail if that's not what they want.

    Do you just hit the high (well low) points.
    -No Insurance, so incured Med Bills on Credit Cards
    -Unemployed for 2 months
    -Relocated back home = travel cost (TX to IN)
    -Poor spending habits

    Or do you tell why, when, where, etc.?

    Just say loss of income...
    If the Trustee wants to know more they aren't shy about asking so then you can give more info.

      Hi Indy,
      I had my 341 mtg today and the Trustee did not ask me anything about why I had to file for BK. He did ask me what was my monthly gross income and since I had filed separate from my husband, he asked if I had transferred any property to my husband. Which of course I hadn't. He asked when our vehicles were bought and why they were in my husbands name only. I just told him that my credit was bad but his was not. He did ask a lot more questions about my husband than I expected. Since I was filing without him I didn't expect he would ask me anything about him but he asked where he worked, what his job was and how much money he made last year. I was starting to get more and more nervous and just kept looking at my lawyer. And then about as quick as it started it was over and he said, "I find this to be a no asset case and you are free to go".....

      It took me a couple of hours to get out of shock because I really found the entire process to be humiliating and embarassing but now that I really am beginning to feel that it is possible to have a fresh start, I am thanking God and feeling more greatful and less embarrassed.

        Everyone has within them a "need" to tell their story. You have this need and so do I.
        The 341 meeting is NOT a place to have this need met. If anything can be answered w/ a yes or no answer...stop there. One word. If it tequires more, be as short as you can. Keep it simple and short.
        Here on this forum we will be glad to listen to your story, your fears, frustrations, whatever will help you get through.
        Remember, the Trustee is NOT on your side. Her/His job is to get as much money or assets as possible. From this they receive a percentage. However, the Trustee is not necessarily your enemy either. Mostly they are just hearing the same story 100 times in one day. They want to get out of there almost as much as you do.
        Be honest. Be concise and courteous. Get'r done!!!
