I have close friends who are halfway through their 13 repayment plan. The wife was laid off and the ch 13 payments were being taken out of her paycheck. They have to go back to the Trustee soon because they are now delinquent on that payment since she has no check to garnish. The payments are $700 a month and her unemployment is $1200 a month.
Their lawyer told them that they can't lower their payments because now they are under the median income for a ch 13 and her unemployment doesn't qualify as income. They were also told if they convert, they will lose both of their vehicles that are included in the ch 13.
Her husband is still working - two jobs in fact. A family of 4 in S. California and his income will be $60k annually if he continues both jobs.
Anything else they can do? Anything the attorney might be missing?
