341 Thursday Nov. 3, Stress Weighing Heavy

Keep your chin up!...My wife and I were very nervous about our 341 this past Friday. In the end we overthought the process. We were told not to bring anything except our S.S. card and ID. We were only in front of the trustee for about 2 minutes and he only asked the standard 6 or 7 questions that are listed all over this forum. He only asked us were we got the value of our time share and we told him from comparable listings on the web. He said he didn't want it because they wouldn't be able to sell it. He asked if there were any cerditors present, there were none. Then he wished us good luck and good day. So easy!!!

Keep it short and sweet. Answer the questions the best way you can. Have your documents handy with an extra copy for the trustee (only if he asks) Try and get a good nights sleep. Get there earlllllly and try and be patient.
I'll be watching, you may never know when or how, but I'll be there. I am there now....

i hate to tell you this but the 341 is useless. i promise it will go so easy. its just a formality. everyone is nice. no problems at all. guranteed.

the bad news is you have to wait 60 days to see if something was caught or someone objects.
Im not an attorney or a trustee. You cant trust me either though!

Charmony, we have all been there, I am inclined to agree with BKfiler. It did seem like just a formality that makes everyone nervous because it ain't really over till it's over, and that is after the 341. Nevertheless, it is normal to feel nervous. My lawyer told me absolutely to only bring my ss card and drivers lic and to not bring all the documents we hear about, bank statements, income tax records, w2 forms. I was prepared to pull all that together but my lawyer who specializes in BK said, you absolutely do not need to bring all that and you are working yourself up for nothing. SO I quit getting stuff together and followed his advice and by golly, he was right. I'm not saying that is what you should do, as I have read others say that it is better to have all that stuff and not need it than to need it and not have it. I truly was going to follow that advice until the final hour, I just decided, what the heck have I got this lawyer for if I don't believe him. So it worked out for me, but you have to decide for yourself what to take.

Just remember, there are so many filers, that the Trustee does not have more than 5 minutes to give you, even if it was excruciating pain you could probably take it if you knew it would end in 5 minutes. That's the way I chose to look at it and it wasn't even close to excruciating pain. It was more of an embarrasing humbling ordeal for me, but not painful.

So good luck, take all of us with you in your heart and know that this is your chance at a new start so the discomfort is worth it.
