Hello. I am a rookie in Texas on this site....came across it last week which is a good indicator of what I am contemplating doing. I am current on my house note and one car note. I am one month behind on one car note and a nonsecured credit consolidation loan at the local bank. We have some credit cards that we are behind on (total balance of less than 2500) and some outstanding medical bils. My wife and I have a good income for our area, but we have alot going out. We want to keep our homestead, livestock, and our vehicles, but I am worried that when I go for my initial meeting with the attorney, he will say that we won't qualify for 13 unless we surrender assets. I am looking for the best way to get things paid and protected. I am also dreading having to deal with the local bank in a small town (gossip, kinfolk, etc.) I guess my question is simply...IS THERE ANY HOPE? What advice advice can you give me?

Don't worry, chapter 13 is designed to help you keep your assests. Your lawyer will come up with a plan that will allow you to catch up on your past
due bills and stay current on the bills that are now current

Your allowable expenses will be determined by standard IRS tables.

Thanks for your replies. I am welcoming any responses. The IRS allowable expense for living is $1501? Does anyone know for sure?

Compare your expenses to form b22 means test for chapter 7 & 13. Make sure you also list all of your ALLOWED expenses. I noticed that they even have a section on the form for phone bill w/ caller ID, internet access, etc. WOW!:yes2: I thought these expenses were included in your allowed housing allowance.
