Question about expenses and disposable income

We have file pro se before the new law and after deducting our expenses on schedule J we had about $200 leftover. We didn't try to inflate our expenses but now I am worried that they are going to try to convert our case into a Chapter 13. Is that likely?

from what i understand, you need to show less than 100 left of disposable income, or they might try for a 13. have you already filed? The deadline for the old law has already passed (Oct. 17).

I have filed before the deadline. Will they take into consideration that my expenses will change? I currently do not have health insurance, I paid for it out-of-pocket for about a year but stopped because I could no longer afford the $350/month pymt. I intend on getting it again once I can get rid of the $400/month minimum credit card pymts. I have made a note of that on my schedule.

good that you made a note of it. Hopefully they will take that into consideration. have you reinstated the insurance yet? If possible you should do that as quickly as you can. From what I understand, the day of filing is a kind of snap shot of your financial condition at the time of bankruptcy.

I too had some readjustments after filing on Oct. 12th. You can file an amendment to the original filing by mail. I am doing this prior to my 341 meeting in December. There is a web site under something like www.uscourts.gov where you can find forms you would need. Don't forget to file the "Summary of Schedules" too listing the changes. It is free to file an income/expense form(s) by mail. You also will need acrobat reader on your computer, I think, to bring up the forms for printing.
