My 60 days are almost up and was wondering how I could find out if the U.S. Trustee has signed off on our case? I have heard horror stories of the U.S. Trustee objecting on the last day of your 60 day period or even after the 60 days is up....anyone have any thoughts or ideas on how to find this out?

i dont believe there is any way to find out until the 60 days is up.
'maybe', but i dont know, you could call the normal trustees office and ask if you have been discharged. sometimes you are dishcarged but you are waiting for them to type it in. you could ask.Im not an attorney or a trustee. You cant trust me either though!

How are your expenses compared to the IRS standards? If they are in line then he/she probably won't object.

My objections are up on the 14th as well. I believe you should be fine, as your income/expenses are not cause for concern, the U.S. trustee unless otherwise notified wouldn't know that you started a new job unless you told him/her. I on the other hand have high income, and a very high car payment. I'm probably going to be one of those cases where the trustee objects the day before or day of. However, I'm unclear as to whether or not he/she can object after the 14th? Anyone know how this works?

the date is set for a reason. if he knew he wanted to object then he would or at least as for a continuance. i think they are allowed to do it 1 time for any reason. if they are working your file then im sure he will object before the 60 days is up.
good luck to both of you! 1 of you will make it for sure! the other one im not sure about hehe just kidding

honestly, from what i see the US Trustee (UST) seems to always wait for the last day. i know that sucks to hear. maybe not worry until that final day only. because there is nothing you can do about it anyway.
im reviewing a case right now where the UST filed the last day. he was gambling (again) and also UST saw income that he coould have so he is being pushed to a chap 13. there are replys going back and fourth. its like a dog fight lol. im on the edge of my seat waiting for the reply for this one.
debtor contends that he is now seeking gambling addicts class (since the previous complaint was that there is no evidence of addiction) seems kinda late eh?
i really have no idea to be very honest. im so new at this crap. but, id be willing to bet a my old fan against your broken toaster that if you dont have extra income and your expenses are not out of line what so ever then the trusttee will gloss over it lol. i know that sounds sad but its what im seeing so far.
worry only on the last day cuz that is when it will happen. enjoy yourselfs in the meantime and dont worry! nothing probably gonna happen but a discharge anyway.

My worry is this....
If I have to appear before the U.S. Trustee at this point and tell him I have regained employment then he will determine that I have much more disposable income then I had when I first filed....wouldn't a trustee want to check with someone in my case to see if they have regained employment since filing to get access to that new disposable income?

I am with ya....
My current job is not a future by any means...just something to put food on the table until I find something better. I would just hate to mess up my chapter 7 and get converted to a 13 just because I started my cheesy new job....I should have waited until after my discharge to start working just to be safe.
How long do I worry....up until the 60 days is over or until I see "discharged" on pacer?Last edited by spooby72; 11-06-2005, 09:37 PM.

the forms ask if you were gambling. personally i would be truthful about everything. if you are caught in a lie it can hurt you a great deal.
talk to your attorney if this is the case.Im not an attorney or a trustee. You cant trust me either though!
