    Normal Monthly Bills & Bankruptcy

    Just curious about monthly bills..in FL

    I had the house phone/AOL bill in my name. I haven't paid it since September and my aol is still working. Would Verizon have received notification of my bankruptcy?

    Direct tv and water is in my partner's name and electric is in mine. I haven't notified FPL and have received any weird demands or security increases, etc...

    How does this work when you've filed and have monthly bills but keep them paid up?

    I didn't include my utilities bills in my bankruptcy (with the exception of showing them as expenses, but no detail). And my lawyer indicated that they would not be informed of the bankruptcy -- how could they, I didn't report the name of my electric, phone, satelitte or propane company.

    I have just kept them current.... and plan to continue to do so that they are not negatively impacted by my BK. I was really worried about my propane company finding out. As they do a credit check -- and based on that you can enroll in a "locked" price program for the winter months.

      If you listed them as creditors, then yes-they would have received notification and the balance as of your file date would be in the BK. Any usage after the file date would be your responsibility.

      Be careful-the use after your file date can turn into a post-BK collection.

        I didn't list any of my house bills on my bankruptcy as they're all up to date. As long as I work & I can pay! With my boyfriend going back to work, it really helps!!! ;)

        I just haven't paid the house phone bill with my AOL on it since Sept., but I can catch up on that one...did the renewal on my car insurance so that will be current when I go for the 341 next week & picked up my tax returns last night so I'll have those too.

        I wonder if my registration will be as good as having the title...mom has the title locked up at the bank and I'm not sure if she'll remember to get it out or just wants to make me freak until the last minute...the application for new title is what I have with my mom listed as the lienholder. Will this work?

          You'll really need that title - your case may be continued otherwise - i.e., you may have another month (or more) of worry added to the process. Who needs/wants that? I saw several cases of rescheduling 341's for people that did not bring titles and other stuff...

          Your mom is already on the title as lienholder, isn't she?

            My mom is listed on the registration for new title that's from October 10th of last year....after that was added to the title, in FL, they send the new title to the lienholder, so that's why she has it...she locked it up so it wouldn't be lost & I've been at her all last week to give it to me so I'll have my file complete for next Tuesday...and now, that's the only piece of paper I need.

            I'll have to call her as I do not want my case continued!

              If the trustee asked for the title, it will be an issue. If not, and he asks at the 341, he'll give you time. One thing-since you have a lienholder-it is not unusual that you don't have it in your possession.

              REgarding the 'after file' date. Lets theorize that you included an electric bill as a creditor & filed on 10/1/05. That utility company company would need to close out the old account, and start billing fresh from 10/1. Anything from 10/1 forward would need to be paid, including a deposit if they billed that. For something like AOL, if you bring the bill current and plan to keep it you'll be fine. But if not, they can list a collection on your credit report for the use from your file date on, so it would appear as an after BK negative account. (Negative credit after BK should be avoided at all costs!)

                Since my home telephone bill includes the AOL...

                and I don't want to mess up with FL/Verizon, I will be attacking that bill as soon as things start to calm down!

                My mom's going to make me a copy of the title to take with me next week.

                I've got my tax returns from 2001 to 2004...they just basically show my alimony received (didn't work...just spent) and my big payment to the IRS early this year on back taxes due for the same time period.

                I had been previously told to clear up my IRS bill before beginning any bankruptcy proceedings...

                Now, when the trustee asks me, "why do you have this debt, again, will my newspaper article from my town be good (in regards to drugs) why I'm cashed out?....I really only want to bring that up as a last resort...

                Since a lot of people are mentioning that Carmax isn't widely accepted for a basis on the SUV, I'm just going to Toyota & have them write something up in regards to necessary repairs vs. value of the 4Runner...

                Man, I can't wait till this meeting takes place.

                      I have heard on various board that the Trustee asked something to the effect of "how did you get into this much debt?" or something like that.
