    GMAC decided not to reaffirm, can I settle?

    We had two car loans with GMAC. One of them we are not reaffirming. The other we are. Our lawyer told us that we were required to file the reaffirmation papers and go back to court. Well, GMAC kept dragging their feet and didn't file the paperwork. Our 60 days were up this past Monday and we are scheduled for discharge this coming Monday.

    Our lawyer called and told us that GMAC decided that they wouldn't file the reaffirm paperwork and we could just do a ride through.

    I owe 3200.00. Do you think I could arrange a settlement with them for about 2000.00? I don't know much about the reaffirm process, I have been
    educating myself here but I didn't see any posts with this situation.

    Any advice would be welcome!

    I don't think auto loans settle but you can try.

    One factor that might help you out is if the vehicle isn't worth the 3200.

    but if it is worth more than 2000, what would be thier reason to settle?

      I suppose if the balance was 32,000.00 instead of 3,200.00, they might have been more diligent in their paperwork.

      It can't hurt to try an offer. All they say is no.

        That's what I am thinking, what's the worst that can happen? I mean to me if they are not interested in doing a re-affirm, it's likely because they aren't going to spend the time or money to come repo something that so little is owed on. A settlement sounds like a good plan to me!
