341 meeting tomorrow

    341 meeting tomorrow

    My 341 meeting is tomorrow, so I've popped back in to read posts on 341 meetings..I sure hope mine is just a 2 minute meeting, too. I checked Pacer again, nothing new, I've never heard anything from the trustee asking me to bring any additional paperwork, so I have my fingers crossed

    One question: Is it possible to see what other meetings are scheduled before mine? My meeting is 1:30, so I don't know if this will be right after a lunch break or if it's safe to show up an hour early to hear some other cases. I thought I read once you could check on Pacer, but I can't figure out how.

    Wish me luck, I will post an update afterwards

    ive seen meeting go right through lunch many times. you should pop in a few hours early to see how they go.

      OK, I think figured out how to pull up the meetings for the day. Since all cases filed between 9/29 and 10/6 have their hearings tomorrow, I searched for my trustees name using that criteria.

      ...there are 116 meetings scheduled as far as I can tell! I clicked through on about 10 cases, and yep, all of them are tomorrow, so my guess is that all 116 are tomorrow. Holy cow! I wonder how far behind schedule they'll be by 1:30...even if at 5 minutes per case, that's still over 9 hours of time.

      I'm hoping this is in my favor...the trustee is obviously swamped and will probably push each hearing along as quickly as possible. I'll arrive about an hour early to get a feel for everything...although I don't know if that will help or make the anticipation worse!

        let me assure you that everything will be so much better then you imagined. its only 120 seconds long.

        and as a matter of fact, it is THE best 120 seconds out of this entire bk process. i kid you not. everyone is so pleasant, no problems, very nice. its as if no one is even talking about the bk lol.

          Ours is tomorrow too! Good luck! Hopefully this time tomorrow we'll both be posting our stories about how horribly nervous we were for no reason!

            Alice, you're not in N. Wisconsin are you?

            I'm trying to be calm about it~90% of the reports are just that, a 2 minute hearing. It's the 10% where the people are grilled that scare me! My greatest fear is having to provide a ton of documents and this dragging on forever.

            I guess I'll find out tomorrow! Thanks to everyone for calming me down a bit.

              Nope, I'm in NW Washington. I'm scared of that 10% too. I've got about every piece of paper I can think of that's not already in my attorney's file. I've got everything waiting by the door, including DS's diaper bag. Our clothes are laid out, provisions are made for breakfast... All we have to do now is get there!

              Even though I'm nervous, I'm just glad it's tomorrow. At least this part will be OVER.

                again, do not give the trustee anything that the lawyer hasn't already reviewed in his own private time.

                  Thanks, BKfiler. My attorney actually hasn't seen some of this stuff, so if the Trustee asks for it, should I just wait until after the meeting and send it to him?

                    honestly, if your attorney has it then let them provide it. if not them give it to him and let them provide it.

                    the point is that your attorney has to know everything about your case and has to provide those things as part of the bk.

                    you shouldnt give anything to the trustee yourself. have your attorney do it. that way:

                    1 - they have evidence of doing
                    2- the attorney can know whats on the documents and why it is as it is
                    3- its their job to do it
                    4 - thats what you pay them for is to do it
                    5 - why would you want your trustee to have something that your attorney doesnst have
                    6 - how can your attorney protect you if they need to if they never saw the document

                    most things can be fax to the trustee the next day via the attorneys office. they do that all day long. also, if you need to bring it into your attorneys office it give you a chance to questions the attorney as to why and what is going to happen.

                    many reasons and more then listed here. pick one that fits yours and think about what you want to do.

                      Unless you have an attorney like mine....the trustee requested some documents within 10 days of my 341, I mailed them priority mail to my attorney the day after my 341. It was over 2 weeks before the trustee received them from my attorney.

                      The trustee sent a letter back to my attorney, requested more information. It was 2 weeks before the attorney mailed me a copy of the letter he received from the trustee.

                      My attorney didn't attend my 341, sent someone else instead. The trustee requested mortgage documents, I sent copies, he wanted the originals. If my attorney had been there like he was supposed to be, he might have known, and told me that I needed to send original documents. Finally, almost 2 months after my 341, I think the trustee finally has all the documents he needs. (our bk was complicated by a seller-financed mortgage on a house we sold, and dh receiving income from a family trust.)

                      Very frustrating and anxiety- producing. I'll be glad when this whole thing is behind us.

                          Everyone has been saying to bring all this stuff- so do you just tell them you don't have it with you if they ask for something?

                            if the attorney told you to bring it or the trustee told you to bring it then bring it.

                            otherwise, what would the difference in time between handing it to the trustee verses giving it to your attonrney and having him do it make?

                            the point is make sure your attorney sees it first and has a copy lol. its not a matter of whether or not you are going to provide it. just make it work for you since you have an option.

                              They will usually give you a short grace period to get the paperwork to them, but they seem alot happier if you already have it. And if you miss their deadline, they aren't happy at all.
