    Any Gainesville GA filers?

    My 341 is scheduled for this Tuesday and I've been fine up until today. Having a lot of regrets the past 2 weeks and seeing 10 years as a LOOOOOONG way down the road.... A lot of explanation and humiliation is what I'm feeling....

    Anyway- I'll be in the Gainesville Courthouse in GA and just wandering if anyone has had their 341 there recently? Anything on the trustees or anything I should expect?

    its nothing to do with 10 years actually.

    any debts discharged are gone in 7 years. the only thing that remains for 10 is the bk listing itself.

    after 2 years you can get a home mortage for better then anyone else.

    after 4+ years or so your credit score (if you pay all your bills on time) can be in the 700's.

    besides, you dont need much credit any longer anyhow probably. deposits here and there might be higher but its still your money.

    thats about all there is to the downside and its not that bad actually.
    Im not an attorney or a trustee. You cant trust me either though!

      My guess is that your credit probably wasn't perfect to begin with since you're in bankruptcy. You'll be better off in four years having filed than you would be if you hadn't.

        341 in Gainesville

        There are 3 trustee's that I am aware of in GNV. 2 men, 1 woman..
        All three are fair, honest & strickly to the point.... Mine was last week.
        Your atty. should of advised you of what to bring already, he or she
        will bring all info needed or told you to do so. If not make sure you have driver's lic. & SS card.
        As well as 2 years IRS returns & at least 3 months bank statements. Also
        you will be ask if you have bought & sold any real estate in the past 8 years.
        You may or may not be ask for your IRS returns & bank statements, but it's good
        to have them with you, otherwise it could delay your discharge date, if you or atty. does
        not have them present at the 341 meeting. Remember every case is different.
        If you have bought or sold property in the last eight years, just be prepared.
        Question is likely to be:
        What date did you buy and what date did you sell and for how much, and
        what did you do with the proceeds? I was ask these exact questions.
        Example: If you sold did you buy another house and for how much.
        As far as your exemptions go, hopefully your atty. has told you what to expect regarding any amount over the limit. the 341 meeting rm. has about 20
        seats . I really goes pretty quick. My only advice would be: ask your atty.
        when you arrive at the meeting about his or her advice regarding the questions about your real estate transactions.. When you answer the trustee's question's just be honest an not elusive or I don't know.. When that
        happens they just dig deeper... Best wishes, please let us know how it went.

          As for the RE transactions we have bought and sold 2 houses in the past 8 years, with the most recent being in July- he did not tell me to bring anything regarding either transaction but does have the closing paperwork on the house sold in July. Never even mentioned the house 4 years ago... Should I dig for the closing paperwork? Not sure that I could put my fingers on it. Might be able to call my agent and see if she still has it on file.

          And double shoot on the 2 years of tax returns. I'll have to start digging right now.... lol~

            You should be fine, Patten's a pretty straight shooter. From listening to
            him, doesn't appear he's fishing.. I would not worry about closing statements,you can always get the tax stuff to your atty.,if trustee wants them.
            just know the month & year you bought an sold on both props. and amounts
            bought & sold. Do you currently own? He also represents BK filer's as well
            as him being a trustee. I've seen him do both.... If you have not bought
            another home and had a gain on your July sale, just tell him what you did with
            money if he ask.. Make sure you & your atty. are on the same page if that
            question arises.. Probably I'de be alittle more concerned about recent charges. If the creditor's do not show your most likely going to be ok.
            If they show, there not going to make a seen in the room, relax a bit....
            All they can do is object. Remember it cost them $250 to file any motion
            or proceeding, plus they (the creditor) have to pay there attys. as well...
            It can become quite expensive for them to say recover $2000..
