    OLD vs NEW CODE

    Due To Pressure I Filed Personal B/r Prior To 10-17-05 W/o Knowing All Of Code Of New B/r Law. Now, It Appears Beneficial If I Could File Under New Code. Is It Possible To Get Court To Set Aside First Filing And Replace It With A Filing Under New Code Since It Would Be More Beneficial Given That The Purpose Of A B/r Is To Assist A Debtor With His Debt Control?

    The new code leans heavily toward the Creditors. It is not a debtor friendly code of laws in any way. Could you be more specific as to what aspect you talking about.

    You would have to give the judge a good reason to dismiss your case once you have filed. Remember, the BK Court has no interest in your welfare whatsoever. The Court's purpose is in reality to determine if relief is warranted since you have admitted guilt and to finally determine how assets should be distributed among creditors.
