    341 Coming up: Attorney says bring nothing

    341 is coming up two weeks from now, and I am not someone who keeps a document for too long although it did change about two months before I actually filed.

    (It was when I was served a lawsuit from my biggest creditor, which was the reason I decided to file)

    I only showed the attorney the pre-filing which I completed, and he didn't even see the bank statements or so.

    Now I received a letter from the attorney to bring the ID and the SS card, but didn't mention any other documents.

    I have to be honest ; I have not shown him any statements or so. He didn't ask for it either. Not that I had anything in it.

    My assets are nothing to speak about. Basically a 5 year old car with 100K+ in it (paid off; I discussed about that in another post.) Hasn't bought anything important for the last 3 years.

    Strangely, I do have some feeling of confidence, but I just want to be sure.

    I am new to Bk myself but one thing I can say is that my attorney said to keep a record of all expenses (receipts, bills, etc.) I didn't show my attorney any records at filing but I think they trust that you will be honest and have proof if asked. I would be concerned because most of the people I spoke with said they needed to take their tax returns and pay stubs to their 341 but you should have a meeting a week before your 341 with your attorney and maybe he will advise you of what you need to bring at that time. Good luck at your 341.

      My attorney asked for 2 years of bank statements and amounts owed to creditors. more concerned that we listed them all and had correct addresses.

        We filed 10/13. At that time, our attorney told us to not bring anything to the 341 that was not requested by the trustee. Now, our attorney had viewed an excel spreadsheet that I had prepared detailing our income and expenses, but had not viewed our bank statements, paystubs, taxes, etc.

        So far, we only have been requested to bring a DL and SS card. Our meeting is *tomorrow*! I'm going to bring things with me and leave them in the car. If the attorney has a change of mind, at least they will be easy to get at.

          My attorney said bring nothing but your ss card and dl, that is what I did and I was not asked for anything else. My attorney did see some of my actual pay stubs and my checking account but did not study them very carefully. Also, I did not hear the trustee ask anyone else for anything other than thier ss and dl. He did ask several questions that were about income and wages but my attorney just directed me to look at what was in my bk schedules. It turned out ok.

            Thank you for your kind advices.

            Since I have no asset and no big surprises, I will simply take the documents, leave them in the car, and show them only if it's necessary.

              its better to not show the trustee anything until your attorney has a copy of it and reviews it. like i saw posted elsewhere, thats like a person being charged with grocery theft for chicken and bread showing up at trial with a bag and proclaiming "no, i didnt steal chicken! look, its a only bag of candy!"

              the attorneys office can fax anything needed right over to the trustee. let them see it and decide what they want to do.
              Im not an attorney or a trustee. You cant trust me either though!
