    Help me advise my son - Needs HELP

    Hello everyone. I've been reading this site for a while & have referenced it quite a bit over the years. First time poster though!

    My son and his wife are having a real tough time financially. They got in way over their heads through some stupid decisions, credit cards, and a problem with the construction of their house. I'm hoping you can help me out with some advise for them, I'd really appreciate it. Here are the facts:

    -They made $115k last year. He made most of this. He is still making this amount of money BUT he is going to need to take some time off due to personal problems (stress) and his wife is pregnant & having some health issues w/ it. Basically, he needs to be there to help out with their two little ones as she simply cannot do it. I expect his income to be reduced in the area of 1/2 over the next 6-8 months!

    -They owe 450k on a house that is worth 350k, if it would even sell at that. The house was new when they purchased it 3 years ago but it is already suffering from major rot on the exterior. It needs 20k of work NOW. They have considered suing the builder but that takes $.

    -They owe $70k on credit cards... They didn't waste money - most of the money is taxes, living expenses, diapers, food, etc. They're paying $1500/mo on these.

    -They owe $100k in gov student loans (50k/ea) and he owes $5k to a private organization for a student loan.

    -They owe $19k on their vehicle that is worth about the same. This is their only vehicle and I think they should keep it.

    From what I've read, I realize they would be well above the median income limit in their state (VA) if he was to continue working full time. But, I'm guessing his 6-month income will put them well below the limit.

    I've told him I think he should stop paying the CCs and his mortgage right now as they can't even afford to go grocery shopping! Then, go talk to an attorney about filing chapter 7. Honestly, I'd like to see him either go rent a house for a while (save $) or buy something cheaper but I'm not real sure about how to tell him to do it. Also, he recently sold his truck (which he needs) because he couldn't afford it along w/ the CC payments! He makes a decent living & is a good kid, just made some dumb decisions. I've been there, I know how he feels & want to help him out.

    My questions are about how he would go about this exactly. Is a chapter 7 pretty cut & dry if his income is below the 6-month limit for his family size? They have 2 kids now but are having a third - will it go on the 4 or 5 person amount? If he goes back to work after the baby is born & his income increases - will it cause a problem for a chapter 7? When filing for chapter 7, if they have some room in their budget (stop paying the CCs and the high mortgage), will it cause a problem?

    I'd really appreciate anything you can offer. He needs something positive.

    You have already given him basic good information. I wish he had not sold his truck to pay for CCs. His truck could be a tool of his trade.

    Not to rehash many asked redundant questions, I advise you to read all the "stickies" on the Chapter 7 forum for a basic understanding of the procedure.

    How far along is his wife, and as you may know, a 90 day hardship leave of absence is allowed without pay without penalty. 'Hub

      I'll re-read them this morning. What does " a 90 day hardship leave of absence is allowed without pay without penalty" mean?

        It is Federal law that a hardship absence is allowed for personal emergencies of various kinds. The employer is not allowed to penalize the employee, but the absence is not paid by the employer. I'll try to look it up for you. 'Hub

            Budman: I can't explain it as well as others may be able to, but your son has to determine what he has as assets, what he has as debts, what his income is capable of supporting. If he is grossly in the red, he would not have to take a "means" test. There are many on the Internet he can practice with.

            He then hires a lawyer who will give him forms and supposedly guidance in filling out the form. The lawyer will file his case (there is a filing fee) and your son will get a docket or case number. At this time, the automatic stay comes into effect. He must take a (stupid) pre 341 course. He can take this before filing and it actually is supposed to teach you something, but it determines if you are qualified for a 7 or 13. The completion form is filed with the Court.

            He gets a 341 meeting in roughly 30 days. This is were his forms have been reviewed by a randomly picked Trustee. He will first get a pre preparation phone call by the Trustee or his paralegal. The Trustee asks him about the same questions as would be asked at the 341. This may or may not happen. FL middle district does this.

            The 341, he meets his trustee. Son's lawyer or a stand in lawyer will be there but usually does nothing. The Trustee checks under oath his SS card, photo ID, and several questions about his forms. Usually unless there is an anomaly, the questions are simple and fast. The meeting usually lasts from five to fifteen minutes. The UST "United States Trustee" may or may not be there.

            The UST has ten days to review if your son is an asset or no asset case. If no assets (property above that which is excluded by law as exemptions) then he has 60 days given for any creditor to make an objection to the case. If it is determined he is an asset case, 30 more days are added and a hearing scheduled as to what your son would have to give up and sell. There is an option to purchase back from the estate his assets. Then the hearing is moot.

            Your son will have to take a post 341 course about budgeting. It can be done by phone or online for about $35 for you and no extra for wife. It takes about two hours but is VERY good. The form must then be filed with the Court.

            If no asset case, and no complaints, after the 60 days or a few more for weekends or busy offices, he will be discharged. At that time or normally shortly later, the case is closed. The target is the discharge, not the closure.

            An asset case is a bit longer as the discharge can come, but the case stays open longer until the assets are changed into cash and disbursed. Then the Trustee puts his report in and the Judge reviews it and motions for closure.

              That does help, I appreciate the time you spent to type it out! From everything I read, I'm thinking they will have a "no asset case" as they will be under the income level (most likely) and they don't have any assets above the minimums as they don't have much. Anything of value they did have has been sold over the years.
