    Motion For Relief...what does this mean...

    Hey I just recieved a motion for relief on my home which I surrendered in a Chapter 7 stating that they want relief from the automatic stay:
    "due too non payment x three months and little or no equity in the property which may benefit estate, trustee's interest should be deemed abandoned. Because of the Security Instrument so provides debtor is responsible for "loan company's" reasonable attorney's fees...and for other such further relief that is just and equitable......"

    What does this mean please help????

    well if you surrendered it then it doesnt matter too much cuz you didnt expect to keep it. but, taking a guess, they are probably just trying to get the entire thing without the trustee getting some of it. this is how the trustee gets paid. they make money dealing with things they take from you. the creditors have to complain that they want it all and maybe that is what you are seeing happen.

    whatever the case, everything has to be motioned in the court back and fourth. and this is probably what you are seeing take place.

    didi you expect to keep the house and are worried? or you are just wondering about it in general?

      OK,
      If you surrendered the house they are just asking for the stay to be lifted so they can start the process of foreclosure to sell you home. Also they are letting the court know they are a secured creditor and the home has no equity in it for the Trustee to go after.

      As far as "their legal fees", since you are surrendering those also should be discharged in your BK....

      Hope you are NOT making housepayments - if so you need to stop.......waste of money.

      Did you file pro se or with an attorney??
