Chtr 13 want to purchase house, husband not in BK

I filled for BK13 in November personal, my husband did not. The house is in his name, we want to sell to get our lives back on course and start fresh but most of all payoff the remaining debt, 2nd mortgage and (2) other credit cards in his name and his car loan.

He really does not make alot of money, self employed, I am the breadwinner in the family. Curious since I in Chapter 13 if I can purchase alone...how easy or difficult will it be. I thought since he really doesn't show alot of income it would be better that I try and purchase.

I need advice...Please! I'm worried sick here.

You would need Trustee's permission to sell and buy another home...... all things have to be reported to him!!
If you have a downpayment - the trustee is gonna want to know where you got it!!!

Are you saying he wants to sell the home and pay off all the debts (his and your Chapter 13)??? Or just pay off his debts and purchase another home??

This could cause a problem in having to restructure your chapter 13 payments.... possibly your portion of all payments (household) would change....

Need to talk to your attorney about this if you had one....
