    Trustee still taking my money!! Help!

    Hi guys haven't been here for awhile now. However, I do have a question and was wondering if someone can help. I finish paying my last payment back in September 8 for my Chapter 13. How about my trustee is still taking money out of my payroll. Then I called and they stated that I'm in a approximately 45 business day audit (and boy did the stress 45 business days not including holidays). I'm a little passed my 45 days and I'm still in auditing. My lawyer is no help, he tells me to wait. I pay faithfully for 3 years and now I have to wait it out. Is there anything else I can do to get this taken care of with my payroll department?

    About all you can do is WAIT - don't want to "irritate" the Trustee, for sure.... he might decide he wants to pay somebody else something....

    Just hang in there, will be over soon....

      Yup. It takes forever. You're payrole department will not stop withdrawals till they get word from the trustee. By the time my trustee finally got around to sending the letter, I had $2,800 owed to me. I recieved that seven months after I had paid the plan off.

      It took six months to get the discharge, after finishing the plan. So prepare for a wait. It really stinks. You work so hard to finish this thing, you begin to make plans-- but that's a waste of time. You're pretty stuck till the trustees do their job. They don't have much incentive.

      After all, you've already paid them and they're getting interest on the money that they need to refund to you. It's a crappy system.

          Sorry you have to deal with this nonsense, but congratulations. My lawyer told me that the majority of BK13 get dismissed due to non payment. It's always nice to hear when things work out for people. Have a great Holiday, and try not to stress over this too much.

            The beauty of that is that you get money back which is yours to spend how you choose. No, they shouldn't have taken it to begin with, but think of it as a rebate. You forget you have it owed to you, then when the check comes you have extra money! At least they do give back the amount they shouldn't have taken out to begin with. I bet there are folks who never get reimbursed.
