    New To BK

    Hello
My bank is USAA. I have about 12K Credit Card Debt with them and have a $2500 loan with them. I cannot make the payments and have not been able to for quite some time. I want to file bankruptcy. My question is, can this be done easily without a lawyer? Who do I need to contact? The county commissioners office? The IRS? Who?
Also, I owe about 12K in student loans, but I don't think thoe can be discharged? Am I right?
Anyone who could tell me some beginning steps in this would be highly appreciated.
    Thanks

    Welcome 'jh998'.

You are in the right place.

First, yes you can do this yourself. Second, you need to get educated. PLEASE read all the "stickies" on the forum you wish to do. C7, or C13, or both.

Nolo Press has a great book, nolopress.com for about 17 bucks to educate you. Pdf download.

You must file in your district in Federal Court. It will cost rounded up about $250 filing.

Without more info, this is what I can do for you this evening. 'Hub
If I knew it all, would I be here?? Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.

Bankruptcy is a process, not an event.......

you have the right to file bankruptcy- but need to know which to file.

I would start with the "legal consumer means test" - just do a google search. It will ask about your income and expenses; giving you a general idea of your situation.

After you have done some reading as others have suggested- set up some free consults with local BK attorney's to discuss your situation.

You can file pro se, if you are comfortable with everything. If you are not- you should hire a lawyer.

        good luck
