    Chapter 7 or 13?

    Ok First of all hello. I have quite a complicated situation. I own a house with my current wife that we pay for on time.Me and my current wife are both on the note. I have my name still on my ex-wifes mortgage, but not on the deed. The ex pays for that house on time she just couldn't get the house refi due to not having any equity in it. I am also on my mothers deed but not the mortgage as my dad signed his half of her house over to me durring thier divorce approx: 6 years ago. That house is worth neg, equity. I have approx: 22k in unsecured debt, and 14k in student loans. I have no money left over in the month after groceries and that is below living standards, i have quit paying my cc just to live. My wife is pregnant and we are soon expecting ... the bad is how are we going to afford it. i make roughly 40k a year but after my pension and taxes i take home roughly 34k. my wife make roughly 24k a year.

    What are my options giving all the worthless realestate in my name. should i quit claim deed my moms house to her and wait a year. What if my ex- wife can never get a refi?

    All the unsecured debt is in my name only so I will be filing seperate.

    I do not have any real disposible income for chapter 13.

    Any sugestions will be helpful.

    if none of the homes have equity there shouldn't be a problem
    with having your name on the the mortgage or deeds.
    the 14k wouldn't be discharged so you would be just left
    with the 22k of credit card debt to discharge.
