My wife and I just had our meeting on Dec 1, received our Favorable Recommendation on Dec 10. We have just sent in our third payment to the trustee and everything was cruising along nicely. Last Saturday the transmissions on BOTH our vechicles went out. We have a 97 blazer that we owed 1200.00 on all three payments were behind and are included in our Chapter 13. So we essentially have no more payments but we have a payment listed on our debt sheet. Our second vehicle is a 98 ford windstar that we purchased thru a buy here pay here dealership our payments have been and remain current. 280.00 a month. My wife is laid off for the Christmas holiday and I am scrambling to find a ride to work we have no means of fixing the cars. probably 3700.00 total in repairs. We figure we are going to have to call the trustee Monday morning for advise. Does anyone out there have any thoughts please

I know the plan can be adjusted for life's emergencies. I don't know how long that takes though. Joe-are the vehicles worth the $3700? If not, perhaps talk to your attorney about surrendering them, and getting something used that DOESN'T need the work. Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

We thought about that. The blazer is practically paid for anyway and so I thought about keeping it and using our income tax return to repair it. We did not include the van. could we call and add it then surrender it and get something else ? My major problem is that I need something now its monday morning I have no way to work. Noone can take me and I cant afford or have a credit card to rent a car the taxi is 95.00 per day I only make 80.00 this sucks

You need to talk to your Trustee as soon as possible.......
Then locate someone to fix your vehicle so you an get back and forth to work.....
The Trustee may let go of the funds to get it fixed with proof of receipts......
Don't be afraid to discuss this with him - he sure doesn't want either of your unemployed.....
Also tell him about the wife being laid off.......they may adjust your payments to the plan....Minny

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.
