    after 341 vehicle question

    We filed pro-se on Oct 14. 341 mtng. on Dec. 16. All went well except we have a 1996 bravada that has a stamped title and bluebook says it is worth $2275. The trustee wants us to pay her for it, turn it over to her, or sue our 19 yr old daughter to whom we gave it, but the title is still in our name. We did not think to add it to our exemptions, but could only exempt about $1200 of it. With a stamped title, the blue book says it is worth $275. The trustee asked how much we paid for it and how long we had it. We said about 1 yr. and paid $4,000 for it. Is it too late to ammend Schedules B and C? Is there any way we can keep the car. We owe nothing on it! This was the only problem we had during our 341, glad it is over.
    The other question is, will we hear anything else from the trustee and when will we know if we have been discharged or not? We do have a reaffirmation hearing on Jan 18 over the phone for our home. We are current on our mortgage and had enough to exempt our home. Worth 55,000, owe 42,000. Not too worried about this, just the vehicle. Any advice out there? Thanks (only the second time I have asked a question)

    you can always amend your schedules. do it right away.

    what do you mean by stamped?

    your vehicle might be worth less then the kbb. you could argue that point and get estimates based on whats in the autotrader, newspaper and yahoo, etc i would imagine. if you call the bluff and tell her to sell it then she would only get market value and have to pay you your part first. if she did that how much would she get. that is the question. as those auctions you dont get tons of people that need a vehicle. you get people looking for deals. that makes the price lower. research the price more and see what its really worth.

    you can check pacer to see if you get discharged. you will also get something in the mail afterwards. it iwll take at least 60+ days after your 341 adn then some more time for them to process your final paperwork and send you the paper.
