I have a good question i need to know before tax time, I filed chapter 7 back in august. My wife was a co signer on the car loan i filed on. The next day they filed garnishment papers on her, The question is sence i filed on them can the touch our jount tax return for there garnishment on my wife? or does my fileing on them stop them from touching it becouse most of the income filed on will be mine ?

It is my understanding that if you filed bankruptcy separate, but your wife is a co-signer, they company is within their rights to go after "the money" from whomever they can get it from. In my state you can't do liens on income, so I can't answer that question. You could file taxes separately.

They can't pursue you for payment, but they can go after her. I've never heard of income taxes be held-except for child support, back taxes, and student loans, but I imagine it is possible. Filing separately may be the way to go-though if you qualify for EIC, I believe you have to file jointly to claim it.
I know getting info out of your attorney at this point in the game may not be easy, but this would be a good thing to ask him...Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.
