    Chapter 7, will they let me? Jail?

    Hello,
    I thank you all for your help in advance. This is my situation..
    I owe $56,000 in unsecured cc debt.
    I have NO property or assets ( I live at home and drive my parents cars)
    I am 25 years old
    I make money, but it is only about $10,000 a year (I am a student)
    This $56,000 is owed from 7 years of c cards (a crazy college spending spree, not proud of it)
    Will they be intrested how I got such high credit with my income?
    They gave me lots of credit while I was in college.
    I am current with my credit card bills and have only paid them by using these methods:
    1. Student loan money
    2. Balance transfers and some cash advances
    3. A little side buisness where I buy and sell stuff on Ebay
    My main question is..will the court accuse me of some kind of fraud because of my debt to income ratio? Will they even let me file Chp 7 if I am somehow making all my payments and never late? Also, I am very worried that somewhere down the line I made mistaken statements on a credit app, but I have no idea if I have done this or not.. If they find something will I go to Jail?

    Hi,

    Based on the information you provided, you meet the criteria for Chp7. Just stop using and making payments on your credit cards, and consult with a few experienced attornies to get a better understanding of what the bankruptcy process is, and what he/she will do.

    Keep in mind that your student loans will not be dischargeable under bankruptcy. So stay current on them.
