Filing Bankruptcy - Chapter 13

I file for bankruptcy, but I am unable to follow through because I decided to get an attorney. At this current point there is a trustee appointed to my case, they are threatning to dismiss it, what can I do to stop it and reapply. Note: I spoke to the courts in New York, NY and they told me once the filing is dismissed I can not reapply. Is that true? and if it is not what can I do to stop it. Sincerely hopeless!!!! :o

Exactly how were you not able to follow through...what happened? Whether you can reapply depends, in part, on why it was dismissed.

Well, I have decided to seek counsel and the trustee has a scheduled date which I have to be there. But I am very confused on filling out the forms and need assistance, I am trying to save up the money for a lawyer. I am in foreclosure on my home and repo for my car and several other bills that need to be taken care of. I know realized that I need a lawyer, but when I spoke to the courts they said I would have to try to get the trustee not to dismiss and they state if I dont appear that it will be dismissed. You see I waited until the deadline to ask questions. :o

I'm new to the forum and have you taken care of this matter already? If not, I don't think it will be a problem for you to reapply, but laws do vary from state to state. When I filed, I hired an attorney first then we set a date and appeared before the trustee. Good luck to ya!
