    When to get a book deal?

    I figured I bring this topic over here....

    So, what if I were to get published and come into some $$ from my little story about my experience with illegal substances...Even if what a year after my bk case is closed, could the trustees come after my riches?

    I would make sure I made not attempt to publish that book or have any contract involving it - FOR AT LEAST 1 YEAR - 365 DAYS AFTER THE DATE OF CLOSING.............

    Its known as "cover your *****"..................

    Would be a terrible shame to work so hard on something and then have a Trustee reopen you case and seize the "benefits" from it............

    Chances of it happening - slim!!! Could happen...... YES!!

    Never dreamed I'd loose my home - was assured I would not by my attorney - SURPRISE - LOST IT - HAD TO BUY IT BACK FROM PERSON WHO BOUGHT IT AT AUCTION....

    So NEVER, say it won't happen...... cause sometimes it does....

      most anything, including work income, that you come into after the case is closed the trustee can not take from you. it never belonged to your estate during the bk case.

      the exeption to this rule is the things they ask you about before hand about like inheritance and of course anything that is deemed as fraud on your part for not disclosing.

        They can come back and say - you knew you were going to publish this book - why did you not disclose it.......??

        Also if you did not know about an inheritance or winning lotto ticket - then get one - they can still take it....................

        Save yourself some grief - wait a spell...................

          yes correct if they can prove you had it ready to go then they can take it.

          since you created a website and created the pages ahead of time then that would be considered potential fraud since you did not disclose it.

          just for reader of this thread in the future, its better to disclose things like this to your attorney and see what he thinks about it. let him make the call.

          keep that conversation you had documented and here is why.

          most likey the attorney will say, eh, ah, its nothing dont bother. then if you ever do get it taken away from by thte us trustee then you have recourse against your attorney. lol someone has to pay...

            I FIRMLY BELEIVE - IF they screw my case up - THEN SOMEBODY GETS TO PAY............... for their stupidity....

            THEY are supposed to be "professionals"........

              minny, by the way, why do you have to wait so many days to start suing? why is the case still open since the house sold? how does this work?

                  its when the property was created. if you make a million off it later then he could argue that it started and was the property of the estate and hence his at the time you filed.

                  its always something. i wouldnt worry about it though.

                    for example, the trustee can take minnys poetry book and sell it.

                    however, i get the feeling he will have to pry it from her cold dead hands before that ever happens lol

                    and even then i would watch out for a latent foot kick that is targeted for his arse

                      The lady attny we had a consult with told us 180 days for Ch 7.

                      We asked her about inheritances during Ch 13 as our parents are already older folk. She confirmed the Trustee can take any inheritance, life insurance, etc., type windfall you come into at any time while you are in a Ch 13 plan. And for 180 days after Ch 7 as well.

                      Now writing a book and making big bucks off "earned" income,......... I don't know if that would be the same thing as an inheritance or collecting on a life insurance policy.

                        if it was copyrights and started before you filed and the trustee were to find that out it would be a fight. youd have to show first that if it was created before the filing date why you didnt list it - thats fraud - and also show that there was nothing much created at the time.

                        oh well, i fonly these things would really happen for us to have to worry about lol.

                          well...my little web page thing on AOL is not in the book...I have like 30 double spaced typed pages....that's about it...I wish I had a tape recorder/video on some friends of mine this weekend; could have made a movie about what happened in 24 hours...lol
