    Discharge Question

    OK, got my discharge and closing will be soon...............question is if there was a problem of any type would I not be at the discharge stage ? I assume the trustee has to approve the 60 discharge and it doesn't just happen automatically.

    yes if you got a discharge then you are as good as 'done'.

    if the trustee was working on something you would not have gotten the discharge. congrats! :yahooo:

          Know what you mean...........you do your best and try to follow the rules to a "T" and hope nothing comes back to bite you. It was such a hard decision to file and the idea that the trustee has control of your estate is more than I can deal with.

            You stated in a early post that your got your discharge on 1/17/06 YOUR DONE EXCEPT FOR CLOSING..

            Yes, we get paranoid during BK - all of us do!!!

            Now go join the discharged Club and wait for closing...

              Proud to be a member of the 60 day club and attending the bar-b-q.......just know that i will be ready for pacer to deliver the status of "closed" soon, then you know its over and done................unless you win the lottery or something.

                no lets not get false info started. a lotto winning from a ticket bought after you filed is not collectable by the trustee or the court.

                however, thet IRS will want their taxes

                      search for that topic on this site. we just discussed it recently.

                      my attorney told me that 401K that was fully disclosed and ERISA qualified was ok to cash out after discharge. maybe wait until close instead.

                      its better to get a job to pay bills then to cash out a 401K however, you will be charged 10% off the top and then have to pay taxes on it as well. its not advisable to do so. honestly, i know. and i will never do it again.

                        Uh, yes, bkfiler, the trustee can and will take lottery winnings(however much he is allowed to) if you win after you file. It is called a windfall. My trustee specifically mentioned this as one of the things he has to be notified if it happens...................Also was on the Debtors responsibility sheet everyone had to sign

                          yes, but thats if the ticket was bought before the filing, right?

                          or at least after the close of the case. if you buy it during the next year and win it during the next year i dont think he can take it.
