    Does this add up?

    I posted an email earlier about how we've suddenly gone from 21.86% of debt to 100%...payment went from $700.00 to $2042...no changes in income.

    We sold house...they took money. Finally, after several days we got in touch with our attorneys. Didn't look at trustee's report...didn't cntact trustee..

    Said "you've been penalized because you sold your house", ignore the report and still pay $700.00.

    I've heard get another attorney...this attorney has already been paid out at 100%...they've got nothing to lose...we do.

    Does this sound right to anyone? We had real lissues with this attorney when we realized we had to move and sell, but not once were we told we be penalized by having to pay 100% of our debt. This is a huge bankruptcy group and there is no way they did not know that if it is true.

    Any ideas?

    YOu mentioned before that your income did not go up-but did you file a revised plan to account for your rent rather than mortgage? They may have deducted your mortgage expenses-they know you're not paying it anymore. But, if you don't file an amendment to show your current set of expenses, they'll only go by what they know.

    Seems your attorney doesn't want to be bothered-but you either need to make him do his job, or get in touch with the trustee.

      Thanks, yes, I'm going to email him this weekend (we have one you can email). We already had to do this during the course of having to move and sell house. Trustee called the lawyers immediately.

      No, I asked our attorney if we had to amend it and he said they'd charge us it wouldn't be worth it since they were about the same amount.

      It's so incredibly frustrating. How can these places stay in business? I guess they don't lose their money...perhaps so far anyway.

        That is probably the issue then. They're not going to leave a mortgage payment in your expense list when they KNOW you no longer have it. On the other hand, they can't assume you're paying rent, etc. if you don't officially inform them.
