My estranged husband filed for bankruptcy ( I don't know which type ). My question is if he filed on the house, what happens to my part of it. I am not on the loan; just the deed. Is he allowed to bankrupt the entire thing? Would he have to buy me out of the house to sell it?

i would get free consults with attorneys on the subject. it sounds important.
if he filed for bk and he gets that loan discharged then he can walk away and its not his problems.
what happens to you im not so sure about.
maybe for others to help answer questions while you are searching for a local attorney to get solid answers, maybe tell us how much the house it worth, how much the loan balance is?
you can join PACER yourself and look at his peition. anything under $10 you wont be charged for until it gets bigger. you will be able to see exaclty what he wants to do with his entire financial debts and property.
maybe he reaffirms and keeps paying. who knows until you look. he has until discharge to state his true intentions but some do it faster then that.Im not an attorney or a trustee. You cant trust me either though!

Who is living in the house? Who is paying the mortgage? Do you want to keep the house?
THose things are important places to start.Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

Regarding you having the same problem.............name on deed but not on mortgage and Ex is filing BK.
Okay, are you divorced??? Who got the house in the divorce?? The paperwork should have been changed after the divorce......
If not, you need to consult with a bk attorney that also handles divorces to see what options you may have.
Hope you did not divorce someone, leave them the house if they would pay the mortgage, then leave your name on the deed also..........Minny

sorry, first message board ive seen that wants a bunch of new threads... anyway..
I am divorced. She got the house. She wanted the house. In the paperwork, I was to quitclaim deed her the house after the divorce. I have not done that yet. She is preparing to file bk. She divorced me and wanted the house, and the payment. Just wanted me off the deed.

Your name still being on the Deed means you own half the house, yet since your name is not on the mortgage, you are not required to pay the debt of the mortgage.
You need to contact you attorney as soon as possible regarding this issue. Whether you can quick claim the deed to her if she has already filed BK or not is debatable. Only an attorney can help you with the steps you need now to protect yourself.....
