I wanted to see if there was any way around a Chapter 7 bankruptcy. She went over my bills and looking to see if there was any repayment option and she said no. She gave me the business card to an attorney and said she was giving me the bankruptcy certification free because I was that broke. She said once I picked an attorney they'll send him my certificate. She said there's too many bills there for them to be able to do anything. She said the good thing is that I was good on my credit and it all centers with having the house and going into the hospital. And because of that they might show a little more leniency. Now I just have to wait for the income tax returns to be able to afford a lawyer.

danielle...so sorry you are having a hard time; at least you tried to avoid BK. BK was not the #1 choice for any of us but sometimes your financial situation is beyond your control. We are all here to support you in any way we can. Let us know if we can help.

That was pretty much the reaction we got as well. They did figure up a DMP for us. Payments were $100/mo more than our minimums. If we can't pay minimum, how can we pay DMP??

The CCCA said to chat with our mortgage lender. See if they would cut us some slack. Chat with our car loan lender to negotiate something there. Seek legal counsel. That was their advise. Didn't out right say "we see no way out for you" but that's pretty much what it all meant. Negotiating something with both lenders would buy time, but certainly would not fix the problem.

I feel like a loser. I mean to pretty much walk in there and they say....well what do you think about bankruptcy cause we don't think there's much hope of you paying that off. I've never been in this situation. I mean I was very smart with my credit. I paid everything off monthly....however the problem became being bed ridden for 8 months and not working. Sure the credit cards were paid off but I couldn't pay the mortgage or anything else that went with the house and not to mention the medical bills that I ended up with. That's what's killing me. I feel really bad....almost surreal.

Oh and another thing.....I don't know if anyone has any advice or if I could even do anything. My older two kids dad found out I was filling bankruptcy, because of my big mouth. As I mentioned earlier my house was foreclosed on when I was in the hospital and didn't get any of my belongings out because of it so I've had to start from scratch. I have 3 kids and they all went to live with their dads while I was in the hospital and they didn't get stuff out of the house, they just went and bought new stuff. Well now that I got better and they moved back in with me they've brought some of their things over here. My oldest two's dad flipped out that I was filing for bankruptcy and took back everything he brought for them. They have no beds anymore and he left me literally two changes of clothes for them. He said he paid for that stuff and he'll be damned if some trustee takes it away when he isn't the one filing for bankruptcy. Can he do that? I feel bad for my poor kids. I let them take my bed tonight while I sit here and search garage sales to try and find at least a mattress. I understand where he's coming from but in the meanwhile it's my kids that don't have a place to sleep.

At this point danielle I think you need to look at it this way: Screw Everybody. You can't control a disease or illness. If someone is so sick in the mind that they think you actually wanted to be sick, to hell with em. Some people are too selfish to understand anything. So all you need to worry about now, is yourself, and kids of course, while they're in your care. I wish you the best of luck in your recovery physically and financially. What didn't kill you will eventually make you stronger and the newfound wisdom will be immensely valuable no matter how much pain you endured to obtain it. And as for a bed, you can get a airmattress at walmart for about $15. I slept on one for awhile and it was the best sleep I ever had. You will still have some tough times ahead but once you walk out of that hospital (or wheeled out in my case lol) you are mos def on your way back up.

Has child support been reviewed lately, if not now might be a good time. How do children feel about what he is doing?
Have you went to the area Salvation Army, they sometimes have matresses? Air mattress is a good idea.
Would check with area Social Services about child support issue, I normally wouldn't suggest that, but hey, he has an obligation to his children too. Don't think the judge would appreciate what he is doing either if you take him back to court.

They didn't tell me it was exempt but now I don't have it. He did say that he was bringing that stuff over until I got back on my feet and could afford to get them furniture....I wasn't sure if I had to list it or not. Now my worry is whether I'll get reemed by a trustee cause he took it back.

Oh we got into that nasty fight too. But because he did have the kids while I was in the hospital for the last year he said he would go after me for back support on that. That would just make my situation worse right now. Or maybe not because running the child support calculators he owes me $850 every month and I would have to pay him based off minimum wage (even though I wasn't working) $210.00. Not sure what to do. My kids were crying that he took their stuff. My daughter kept telling him she's only over there 1 day a week and it wasn't fair. Which he told her that when she did go she was grounded for mouthing back at him. I wish he could see the @$$ he is being.

Him go for 'back support' on you while you the mother are in the hospital. Yeah thats a good one. Did he actually fool you, because I think the only one he was fooling was himself.
