    Trustee Share Of Tax Return

    We filed October 4th and were discharged Jan 12th. The trustee made us sign something saying we would give him part of our tax return. Does anyone know if a trustee would even consider a letter of hardship or do they really not care if we need that money. I think it is worth a try but my hubby thinks we should not rock the boat. Any advice is appreciated.

    If you can't exempt it, keep in mind its a paycheck to the trustee. Everyone in BK has a hardship, afterall. The % will be roughly 75%, based on your file date.

      Can he take our child tax credit, or my education credit? It just sucks that the reason our return is so high is because I got caught up on my taxes and my mortgage on top of the child & education credit.

        For most states, the child tax credit is clear. I don't know about the education credit, but I think its just income tax refund that is the issue. (Consider it like a savings account where you were paying in all year. If you get your withholdings back, that was an asset when you filed BK.)
