    Newbie with Tax Refund question

Hi.. I've been lurking here for a few months but this is my 1st post. I've read several posts about tax refunds, but I'm still confused.

Here's my situation.. filed 10/8/05, and was just discharged today! Woo-Hoo!! I am expecting a large tax refund (somewhere in the $3500 range). My lawyer told me not to worry about the refund and the trustee didn't mention it at the 341. I'd like to file as soon as I see the case is closed as I desperately need the money for things that have been neglected (car maintenance.. etc) My question is how will the courts know if I receive a large refund? I'd hate to spend the money and then have them ask for it back with no way to pay it back.

This is a awesome board! Thanks to everyone for all of the great info!

Most likely, the trustee would have mentioned it by now if he was interested in it. If it is mainly EIC or child tax credit, it shouldn't be an issue anyhow.
Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

I sent my taxes in yesterday! I am getting back several thousand. I was discharged on 1/09/06. Trustee never asked about income taxes. Income taxes from the previous year were figured into montly income though. Not sure if that makes a difference.

        How come these lucky people...

are getting to keep their refunds and my ding-a-ling trustee is taking mine when it's around $500?

Is it because I scared him out of taking the 4runner?

        What gives?

No biggie but I just wondered, my trustee must s*ck.

Must depend on where you live and who your trustee is. I have to fork mine over also....

Amislander-my guess is your trustee is being spiteful because of the forerunner. He has likely figured out that it isnt worthwhile for him, and doesn't want to give up completely.

Thanks for all the replies. A good portion of the return is child tax credit and EIC so I guess I will just file and hope for the best. Thanks everyone!

                taxes

I have the same type of mean Fla trustee that wants us to send in copies of our tax documents when we file. I think that means he wants to take our refund. GRR!

cant you tell the irs to keep it so that it can be applied to next years taxes as a first quarter payment. and then tell the trustee that you dont expect to get much back lol
