    Awaiting Discharge - Got Bonus

    My last day of objections was Jan 31, and I checked Pacer daily from Feb 1 but still nothing.

    I even called the court, the attorney, etc but nothing (I live in a big urban area so the courts are busy).

    Well, as fate has it, my company did decide to give me a $1500 bonus yesterday. (It doesn't know I have filed)

    It is not a payroll check ; more like a personal 'gift' from the owner of the company. So I received it as a personal check, written by the owner.

    I have set that aside. Should I wait until I get formal discharge, which is still several weeks away?

    P. S. My actual tax refund (about which I asked the board before) swelled to about $1,400 thanks to some actions I had performed last year without knowing its tax consequences.

    I do intend to file the return until I get the discharge, although I don't know whether it is a good strategy.

    i cant figure out if you filled taxes yet or not.

    nonetheless, you cant hid the money. its not that easy. regardless of a payroll check or personal check, sooner or later its going to come out if it looked into.

    but none of that matters, you are past the objections point, trsutee didnt say he wanted your taxes i assume, and no creditors seemed to have complained so i think you are done and you should feel free to spend your money imo.

      I haven't filed the tax yet, intending to wait until I get completely discharged.
      The trustee said nothing about tax refunds.

      I intended to say that "I intend to delay depositing that check until I get discharged completely, but do I really have to wait until then?".

        no. you are on the end of a bk. not at the beginning where you could file taxes, get the check, spend it and trustee would have to try to get it.

        at the end he can just take it if he wanted to and now would be the time. but he didnt ask right? so its yours. file anytime you want imo.

          The taxes (or portion of) is part of the BK estate. A bonus received now, that was in no way due to you or earned at the time you filed BK, is NOT part of the estate.
          Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

            opps i forgot to speak to the bonus. my bad.

            yes the bonus is yours more then likely given the cirumstances. i bet the trustee could take it imo. but then you could expempt it if you had any left.

            but i think its done and over with and you are home free.

              Save it til your discharged, then cash it, and I hope you feel like sharing

                I decided to put the money in today. There is nothing in the mailbox, pacer or the court system yet, so I will probably have to judge that nothing is going wrong.
