I live with my girlfriend and her 3 kids,in massachusetts.My 2 sons live with there mom in new york,full time since our divorce 5 years ago.I would like to know if i can base my median income as a single wage earner,instead of a family of 2,3 0r 4?I will be filing chapter 7,hopefully!

i think you can do whatever your want. but remember that if you base your income off of 1 member famly then you cant show expenses for the rest of them either. i would imagine its better to use more people.Im not an attorney or a trustee. You cant trust me either though!

Who get's to claim your kids as deductions on income tax?? If it's you EX then you should be a "single" person for purposes of BK.
You will be asked to disclose any payments you make to EX and kids, such as alimony and child support. Generally what ever you are required to provide in the way support per the divorce decree. Those types of payments are considered Priority and must be paid before any Creditors see a penny.Filed Ch 7 - 09/06
