    ?????Help!!!

    I got a paper today in the mail that said "Discharge of Joint Debtors" and it's from the bankrupty court . I confused because in my 341 meeting the trustee said he wanted my 2005 tax return. I have not filed yet so is it really discharges or do I still need to send the return to him? I also have a truck that I kept and I did not sign an agreement to keep so can I still turn it back to them?

    the tax issue might keep you rbk case 'open'.

    a discharge comes anyways, relgardless of what the trustee wants to take from you. so thats great news!

    if you didnt sign a reaffirmation agreement then all you need to do is keep making payments and they probably wont pick it up. also, in the future if you decide to not pay for it then it cant go negative on your record.

    if you dont want the truck anymore then go give it back to them or tell them whwere they can pick it up at.

      ...regardless of the discharge, you will get a letter stating such...

        The discharge closes out your obligation to make any direct payments to your creditors. The case will not close until the trustee has received & distributed any assets-such as the income tax $$. Even though you won't have to pay anything to your creditors now, they may still receive money from your BK estate.

        You should be able to surrender the truck, as you did not reaffirm. If you are behind on it-keep in mind they can repo it now that you're discharged. You can call them to arrange a surrender on your terms though. (Rather than them coming in the middle of the night for it...)

          Yes you still have to submit our 2005 income taxes to the Trustee..... Your case is discharged, but not closed until the "tax issue" is settled.

          If you did not reaffirm on the vehicle you can turn it in at any time in the future and and the balance would be discharged. (as long as you included it in your bankruptcy).
          If you signed reaffirm papers - then you would be responsible for any balance owed if you turn the vehicle back in now.
