    Can I please keep my tax refund????

    Hello!

    I filed for Chapter 7 in October '05 (UTAH). My 341 meeting was in November, and I was just discharged in January.

    At the 341 meeting the trustee told me he wanted a copy of my tax returns. I was given a paper that says quote "send in a copy of your tax return by Feb. 15th. DO NOT CASH YOUR REFUND CHECK!"

    So I am working to hurry and get the taxes done (hmmm....he doesn't think I'll actually have a REFUND yet does he?) Sorry that is off topic.

    My question is that my federal refund will be about $4000-- ITs all due to EIC this year. Meanwhile, my husband is STILL out of work and we desperately need that money. We also need a used vehicle since our only one was repo'd a month prior to the Bankruptcy. WIll the trustee take it all???

    Also, would it be inappropriate if I sent a letter along with the tax returns telling how much we need that money for a car etc?

    Any info or advice would be very appreciated!

    From what I understand the trustee can't take any amount from you that you would get because of a credit for your taxes...

    My trustee did not ask to have mine, and I have an education credit each year...

    I could be wrong, but that's is my 2 cents...

      you still need to send it to your trustee if you case is stil open. which i would imagine it is. detail how much of it was for tax credits and hope he doesnt take it out. its gets tricky. some tax credits are for certain purposes and he is allowed to take that money. cant recall which ones that is for.

      i wouldnt expect a lot back or should i say dont count on it.

        tax refunds

        I am hearing this thing, about loosing my tax refund, for the first time. We had our 341 meeting for chapter 7 last month. We usually get $3400 - $4000 back in April for EIC and the other child one. Does the trustee want me to turn this money over to the courts?!? I had no idea and I'm really floored. I actually wait for this money every year to catch up on all sorts of things we need. Really need. I claim the maximum exemptions too and I'm reading that isn't a good idea either...

        Can someone enlighten me as to how I can find out more about my particulars, WA state and so forth.

          You will have to see what you states guidelines are....it is funny.....I live in IL and some people in IL had their refund checks taken from them, but we did not.
          I heard the rule usually a percentage would be taken....we had filed on Sept 29th 2005...so if the trustee wanted it he would be able to take 9/12th of our refund...since Sept is the 9th month. However I heard that EIC was exempt. Sorry I don't have more info.
