Ok new here. We filed did a DIY chapter 7 in ARIZONA in 10/2005 and are stil in the 60 day waiting period or whatever. Our Refund would be somewhere between $1500 and $2200 would be the max. Plus I owe liek $230 state tax. I remember the Trustee said something about sending him the tax return, but I don't remember about the refund check. I was wondering do I have a chance at keeping it?? Should I wait to file untill after the case is closed or discharged or whatever?? Or will I just have to give them the money anyways. We don't have an attorney or anyone to consult so I need a little advice. Anyone with any arizona knowledge.

Refund question, when to file!

If the trustee wants to see your return, he will not close your case. You'll need to send it to him. Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

So should I..
just go ahead and file my tax return?? Or just wait and see if they send me anything asking for it... I'm not in a huge rush to file. I haven't got any papers in the mail since our 341 meeting. Should I just wait wait wait, or should I write/call the trustee or something.
Help, Help??!!

You need to go ahead ad file your income taxes. If you receive a refund, it must be turned over to the Trustee...
If you don't receive a refund, you need to have a finalized copy sent to the Trustee showing - no refund....
Waiting to file your taxes will only prolong everything and drag it out.
This you don't want to do!

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.
