    My First Post

    Hi Everyone. I'm thinking about bankruptcy-because I don't know what other options I have! The past year has been truly unbelievable. The short story is my mom passed away (she had been sick for a long time), so I took on the responsibility of my younger sisters & nephew. Right after that, my husband must have stopped paying the mortgage, though he never let me in on that little secret. I didn't find out until a lot later when the foreclosure process started. I moved out-thanks to a friend who has a house I can rent, and now he has too. (We're not together, the house bit is only the tip of the iceberg. His other secrets apparently includes the discovery that he likes 'em younger than me-and I'm only 33!) I am certain to owe money once the house matter is finalized though WHO KNOWS how long that will take. I also have some medical as I have the same medical issues that my mom did, some credit cards, and owe utilties, cancellation fees on cell phones, etc. I haven't been using or paying on the credit cards for a few months now.

    I work 40-50 hours per week. My husband & I also ran our own business for the past 8-9 years but it isn't something I can do on my own and I can't deal with him right now. My income is usually about $2500 per month with the overtime, and our business listed something in the area of $15,000-18,000 per year for the past few years. I haven't organized to figure out for 2005 yet, but it will be less since t was not for the full year. The idea of bankruptcy makes me nervous, and knowing there are new laws doesn't help. I don't have a lavish lifestyle-my priority right now is surviving another day.

    Well, if anyone has any suggestions on where to go from here-I'd love to hear them because I really don't know.

      Sounds like you have many issues right now that you need to deal with:

      1. Whether to file Bankruptcy or not?
      2. Marriage - is it over?
      3. Taking on additional family members as dependents.
      4. Dealing with previous death of a parent.

      You said you had already moved out of your home and was letting it go to foreclosure.

      Since you have cc debt, medical bills, foreclosure, etc, the best option open to you may be to file bankruptcy and get a clean slate to start with...... (your new future!!)..

      You need to sit down with an attorney and let him decide what options are best for you..... (consultation is usually free).....

      If your husband is NOT A KEEPER, file bankruptcy yourself only.......stop the foreclosure on the home and included it in bankruptcy along with all the cc and medical debts.....

      Let the attorney know that you have taken on the responsibilty of others children..... I'm sure that since they are now part of your household, your exemptions will be a lot more......

      Do not wait - find out from an attorney what your options are - Do this before the home sells and you end up paying for something your not living in...
