Has anyone heard of someone getting to keep something that was clearly not exempt and was overlooked/(paid off piece of non exempt land) Can this be possible or is there some sort of safeguard that would catch this on their part?

It could happen-if the hassle of acquiring it was not worth the $$ it would bring in...Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

It could be either-if you see on Pacer that you're closed, then they aren't bothering with the asset. If you haven't heard anything, though, my guess is they don't want it...Most of my information is from personal experience or HOURS and HOURS of online research. Its a proven fact that trustees will not fool with land or property (boats, etc) that are either exempt or tied up so tight they have to take everybody else to court to get at it.... so they just pass and let you keep it....

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.

Discharged means that your creditors can't get anything from you post filing. If your case is not closed, however, the trustee could still take pre-BK assets. Have patience!
