I need some advise. My husband and I filed a joint chapter 7 in September and it discharged on 1/4/06. I have a condo under my name and the Trustee is saying that it has to much equity. She faxed a letter to my lawyer in December asking that we pay $53,000 from the equity. As soon as my lawyer got the letter, he asked me to see if I can refinance in order to get the money. Unfortuanately, no lender was willing to do it, but we got a private lender that is willing to lend us the money with a VERY high interest rate. Need less to say, we are going to be worse off than we were before we filed bankruptcy. The weird thing is that since December, we have been trying to get in touch with the Trustee so that we can close the case and pay the money, but she has been ignoring my lawyers calls and letters. The crazy thing is that she filed an order in court to hire a real estate broker for my home. She did this after my lawyer told her that we have the money for the equity. The good thing is that my lawyer has all the letters and phone calls documented in our file and is going to go to court to stop her from using the broker. Since it has been almost 2 months since the discharge, how long can the trustee ask for the money? By the way, she came up with the calculation on the equity amount herself and only faxed over a letter to my lawyer. We have never seen a copy of the letter or a notice from the bankruptcy court saying that we have to pay this.
