    How Long Do I Have?

    I have to turn most of my refund over to trustee (greedy son of a gun). I recieve my refund in the mail but I was wondering, how long do I have to mail it to him? I would like to pay my house payment and then give him my school loan money when I get (april 1st). Will the trustee know that I have had my refund check for a month? I don't want to piss him off, but I need money today.

    I think you're supposed to send the actual refund check. Exactly what were you told to do?
    Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

      Actually, the letter from trustee says to send a money order or cashiers check to him directly. does this change things, how will he know when I get my return, cash it and forward it?

        We had to send in most of our refund and we sent it in forewith. Our trustee is only discharging asset cases who have either turned over property as they were required and/or submitted their tax refunds as ordered. I verified that on reports in Pacer--only asset cases have been discharged by this trustee since 10/14 (our filing date). I bet they monitor by going to the "where's my refund" at the IRS website and checking on the status, too. I did notice that some people who were asset cases for their refunds were served motion to compel, so. . . We also had to send a copy of our completed 2005 tax paperwork, too, and then send the refund immediately after receiving it. So I would just send the trustee what he wants--its not worth getting dismissed over.

          How does everyone get their refund so quickly? We were told that we could not file electronically. Is that true?

            We filed electronically but we were never told not to file electronically. it probably depends on the trustee.
