    Foreclosure and then BK

    I am moving overseas and filing for divorce and then filing for BK. The thing is my house will foreclose before I can file BK. There is a negative balance. Can the house foreclose and then I file Chapter 7?

    I believe you can. Just make sure to get all your stuff into storage, you don't want them to come in and discard everything while you're overseas.

        No I am not in the military. I am an Australia citizen but have lived in the USA for the past eight years. I am moving back home.

          What exactly is it that you are worried about then? I don't see anything for you to be worried about unless its something you haven't told us.

            My attorney said that I can not forclose first. He said if that was the case I they would not discharge the negative balance. I have been researching and I do not think this is right. I need to wait because I currently make too much money but once I move that will not be the case. I actually want to wait as long as possible top file Bk mainly because I don't think anyone will come after me in Australia and if that is the case I don't care about having bad credit here. I am so confused about divorce and Bk. I spent hours yesterday with my attorney and I feel like I have hours more questions. He seemed to think all I needed to do was sign papers and right him a check. Is this how it works?
