    Pot Plan / Questions to ask your attorney / General Information

    Here is a couple of questions you can ask your lawyer.

    1) What kind of things in the new law are you restricted from telling me? There answer might be things like...well, I cannot tell you to incure any new debt before you file, I cannot tell you to ... ect. There is alot of information they would love to tell you but cannot. I believe if you word the question correctly, you might find some good stuff out.

    2) Make sure your Chapter 13 is a Pot Plan. This is a great. My attorney told me that the pot plan meant that if you won the lottery, as long as you paid the pot plan off, you were done. This keeps you from loosing any inheritance, lottery winning, ect. I am not sure how you get in the pot plan, but my attorney has that box checked.

    For those just now starting there chapter 13, there is still alot of intrepretation in it. In my district, for example, they do not want to even hear about tax refunds for calculation of payments. That was good news.

    There is alot of loopholes that the cc industry will be spending money to close. I always feel that bk is a last resort, but if your desparate, time might be good to file.

    There are LOTS OF THINGS your attorney won't tell you, and even if you ask they won't.......... but if something comes up in your case they will tell you "it's more money to solve the problem".....

    Ask questions, don't let them push you aside with no answer..... YOU DO PAY THEM..... REMEMBER THAT!!

    If you are uncomfortable with your attorney........find another....

      What Aa is talking about is a New Law thing, Minny.

      Attnys cannot, by law, give BK filers financial advice. It's part of the New Law.

      We only had one attny tell us to sell our truck to pay our taxes. Get our tax issues settled before we filed. He's the only one that said it. But even then he didn't say it directly.

      He advised that it would be best for us to resolve our tax issues with the IRS prior to filing for BK. Whatever route we chose was strictly up to us. By the way, have you advertised your truck to try to sell it?? **wink wink** That was his approach.
