Well, the anxiety of filing is now behind me. I have signed the paper work. Attorney said she would file it today electronically, but she had one question on how to input some "unique" financial information (said it wouldn't change anything) (Stange yahooing on this, but I sure feel better today anyway)

Now, anxiety will start brewing concerning the 341 meeting. I'll worry about that next week. She said the way things are going here, I could expect it to be in the middle of May.

Relax, things will work out in the end. Our 341 went better than we expected. I don't understand why most people have to pay attorneys fees in a chapter 13. Our attorneys fees were included in our plan. The only thing we needed was the filing fee. Our attorney said this way our unsecured creditors were actually paying the attorneys fees. He was payed in full by the Trustee 2 months after our plan was confirmed. He charged $1700.00. He was kind of odd but he did a good job. Good luck.

Thanks katze, my attoney wanted 1/2 the fee, the other half came out of the plan. My thought is that I guess if you skip out on the chapter 13 plan, the lawyer gets nothing as well without filing a lawsuit.

Well, after reviewing the million pages of the petition and supporting paper work, there are so many mistakes my attorney made filling the papers out, looks like Monday to file was a pipe dream. One really big mistake...spelled my name wrong. Thought about not telling her that, and using that afterward to tell people it was a different person who filed! LOL!!!

Good thing you decided to read thru those papers.

At least you can have the errors corrected pre-filing and keep your process moving along on the normal time schedule.

Just an FYI about the attny's fee. Ch 13 attnys get paid right off the top. Out of the first few payments into the plan. So depending on your payment and how much you owe the attny, unless you falter within a few short months, the attny will get paid in full.

We had mistakes in our paperwork also. We didn't look at it real close before we signed. After we got home I looked at it closer and found several mistakes. I e-mailed our attorney and explained the mistakes. He e-mailed me back and said don't worry we will bring it up to the Trustee at the 341 meeting. That worried me so I called the Trustees office and they told me not to change anything before the 341 meeting. Our attorney brought it up and the Trustee didn't say anything about it.The 341 meeting was recorded so I guess we're covered if anything comes up later. Funny thing was one of the mistakes was in our income. We should be paying $100 a month more than we are.

AA---- don't sweat the 341 meeting!! I know you will dread it because we all do no matter what anyone says, but you will have the HUGEST feeling of relief when its over, and you will find its not bad at all, and usually takes about 5 minutes.

Just talked to my attorney, and all the mistakes have been corrected and she will file my papers within an hour to two. She was able to keep my payments the same, and she did say there might be some haggling that has to be done in the end to come up with the final number.

One thing she did say, that almost all (not 100%, but close) have to adjust there payment before it is finalized. She also stated that the trustee here is starting to haggle over them a little more right now...geeze...just in time for me.

I'm starting to think my lawyer meant all her chapter 13's changed a little!!! I love my attorney to death, but after the large number of errors on my bk petition, I am starting to wonder about her.

What a weird feeling it was looking at Pacer and seeing my name....god, it was awful. Well, 341 meeting on May 11, 2006.

Good luck, I'm still lin limbo land. Seems the trustee has a hard on for us. We were a conversion from 7, and they just seem to think we are made of money for some reason.
