    Student Loan Status In Ch 13

    Hi,

    I know there have been lots of student loan threads, but I was wondering, does anyone have any experience with Sallie Mae while in a Ch 13? I went to log on to my account recently to check my balance, but it wouldn't let me in. I called and they said it was because my account is on hold until the discharge. I asked what if I want to make payments, and they said I can mail them. I am frustrated because I enjoy the convenience of online payments. I have 29 months to go until discharge, so that's a long time to wait to get my online access back Plus I won't have any statements to check up on how my payments are being applied, I want to make sure they are processed.

    I thought you couldn't make payments to student loans while on Ch 13. We had actually included them in our plan initially and when we went to our 341, we were told to exclude them (therefore, adding more disposable income to our plan) because that would be consiered preferential treatment. So, we can't make payments to our loans, as far as I know.

      We are able to make student loan payments in our Chapter 13. They were used as some of the expenses we wrote down. With all of student loans we have to mail our payments in, including Sallie Mae. So, we too do not know how much we have left to pay on them.

        I just noticed in the past month that Sallie Mae changed how they are reporting my loans. Before, it always said, "Payment Deferred". Now, it says it is a "Derogatory" entry and says, "Included in Ch 13" or "Wage Earner Plan". These loans are not included in my Ch 13 payment plan, I was told by my attorney that they would go into automatic deferment and I was free to make payments to Sallie Mae (to cover interest, etc) if I wanted to.

        Can they report negatively like this? These loans are not dischargeable and will go into repayment once my Bk is discharged. I am asking because I noticed my credit scores dropped with this new reporting. I sent them an email to verify, because to me it doesn't seem right, I can see my credit cards being reported that way because they are in my plan and dischargeable, but the student loan??

        Any help would be appreciated!
