    Mortgage Payments in Chapter 13.

    I received my packet of information from my attorney today with the court date, and things she said I needed to read prior to the 341 meeting.

    The letter also stated I needed to contact my mortgage company to find out where to send my payment since I was in a chapter 13. Has anybody else experienced this? I just assumed I would send my payment to where I have always sent my payment.

    While you're in a 13 plan, the Lender is under stay and cannot contact you. Also, they generally handle BK'er's payments thru a different office than regular folks payments go to. Others here have commented about that.

    Be sure to get the correct address so your payments will be properly credited while you're in the plan.

      That sucks, even the creditors I'm paying treat me different. This is crap.

        Yes creditors are going to treat you different........you filed BANKRUPTCY.............
        If you are paying some of them - they should be counting their blessing.............. you could have discharged them also......
        One thing, you won't get a Gold Medal for filing bankruptcy........

        Lots of headaches go along with filing bankruptcy so try to stay calm, cool and collected thru it..... the end result will be worth it....

          It's more an administrative thing than anything else, I'd think.

          Since they can't contact you due to the Automatic Stay, it would place your account handling into a different situation for the Lender.

          So you mail your payments to a different address than before??!! Your mortgage lender is gonna continue to report your payments to the CRA's and you'll get credit for making the payments as agreed.

            All it is is a separate department, at the same company. They do it this
            way, as SF said, for administrative reasons, because people in bk have to be handled differently by law. For example, even if you fall behind on your mortgage payments after you file, they cannot even give an automated reminder call or anything because you are protected by the relief from stay,
            until they actually file and get that removed.

            Also, one time I called and asked how much I owed because I thought I might have had a late fee added and didnt know exactly how much the total was,
            and the rep couldnt tell me. I basically had to tell her how much my monthly
            payment amount was, she told me they didnt charge a late fee, and then she
            said, "you have to tell me how much you want to pay." Otherwise, it could have been misconstrued as trying to collect, which would be illegal.
            People in the bk area are specially trained in the legal aspects of it, thats why its necessary. Wells Fargo sends a special statement that basically has
            a disclaimer on it that says something to the effect of, "this is for informational purposes only, if you wish to stop receiving this, please call".
            Then it otherwise looks like a regular statement pretty much.

            So, aa, try not to take it personal, its actually in large part for your own benefit.
