341 over with! Finally! Waited 6 mos. to the day!

    341 over with! Finally! Waited 6 mos. to the day!

    After waiting so long (filed on Thursday October 13th, 2005), I finally had my 341 today. I would say about 8 people were there for the 4PM group. Everyone had an attorney but me. My heart was just pounding when he was reading off the "rules" for the 4PM session. I was called after about 3 people.

    What a stare down; very innocent yet straight forward looking man (trustee). I gave him my ID and let him know that I didn't have my SSID with me; was lost in some folder that I misplaced immediately after receiving notice last week that the original 341 meeting was postponed until today. I showed him a W2 form and he accepted it as proper ID in addition to my drivers license. He asked the basic questions (address, did you file your own stuff, etc.) and I never blinked an eye. He was interested in if I have received any legal assistance with this matter and were I got the filing documents. I replied with a "no" and that I used a book I purchased at the bookstore to assist me along with help from the USBC web site. What I find odd is that he didn't ask me any of the other questions I heard the lawyers read to their clients in front of him. Stuff like "Have you had any changes in employment?". He just stated that a creditor would like to speak. The creditor seemed to get really pissed off when asking the questions to the point I thought he was having a stroke - kind of as if he was very under prepared and I like I owed him money personally.

    The creditor continued to blabber off some other stupid questions that really in my opinion were pointless; everytime he asked a stupid question I would look at the trustee and he would kind of roll his eyes. He asked about the condition of the collateral vehicle of which I replied back, "Well the engine runs very rough probably due to the 158,000 miles on it and the brake lights don't work". He started to get pissed about why I was trying to fix the brake lights and not the engine...what gives?

    Trustee said that I am all set and to speak with the creditor outside. I said "thank you" and the trustee said "thank you" back quietly. The whole conversation with the trustee lasted no longer than 30 seconds.

    Again, is it because I was the only one to file pro se that the trustee didn't bombared me with questions? I was expecting to face the music of every little detail.

    I hope that today was it; I kind of felt wierd leaving - as if I wasn't supposed to leave yet. Just seemed to fast. I don't feel relieved at all either.

    That feeling of relief will come when you get the papers that say DISCHARGED............................

    What happened with the creditor regarding the vehicle?
    Did you surrender auto or reaffirm?

    Yes, some Trustees CAN BE NICE.............. it's the money hungry ones that are the bastards.............

      Did you speak with the creditor outside? What was the creditors point?

        Well unfortunately the collateral vehicle went to hell about two months ago. I swear that I did not intentionally do anything to the truck; I planned on keeping this for many years to come. First the shift column snapped - basically $800 in parts and labour to repair. I chose to just put on a heavy leather glove and manual move the cable like a redneck. Then two days later the drivers door handle snapped off. Then a week later the engine started to run wicked rough. Was very wierd since I have babied this truck for the last 2 years I've owned it.

        I told everything written above to the creditor in front of the Trustee; creditor was not happy at all lol! I guess I wouldn't be either if I was in his shoes. He asked if I want to reaffirm the loan with them. I looked down at my papers and said "at this time I am unfortunately unable to reaffirm on any of the loans".

        I watched about 30 minutes of cases from the 3PM session and everyone had lawyers and houses. The trustee didn't seem to be a jerk or anything.
