    have to sell my house because job is moving

    I'm at the half-way point in my chapter 13,now I must move out of my house because my job will be transfering me.Will i be able to get a apartment and can i sell my house and get any money from it and hopefully pay off the rest of my chapter 13. any advice will be welcome,thanks in advance

    First thing you need to do is contact your attny. The attny that filed your Ch 13 plan. If you filed Pro Se, you need to contact the Trustee's office directly.

    When you are in Ch 13, the Trustee must approve something like selling your house. Your Ch 13 plan may possibly have to be transferred to your new location as well. I don't know about that part.

    But, definitely, the Trustee needs to know what's going on in your life, and approve you selling your house before you sell it.

      We had to do this as well.

      No one wanted to deal with it at all until we had the actual signed contract in our hands.

      Then we had to get the attorneys to get permission from the trustee to ok the sale. The attorney was just playing around so we ended up having to call the trustee so he would interject and put the fear of God in the attorney's office.

      Then we had to get the buyer's bank to send a check to the trustee for the court's portion of our profit.

      We got to keep $10,000...the rest went to the court.

        When you do sell, you'll get to keep the portion you exempted in your Homestead exemption. What ever that $$ amount is for your State or from the Federal exemptions. Which ever you used.
